Scope of Application
Contractual relationships arise from the purchase of tickets between the ticket holder (customer or ticket holder) and Weltraum-Atelier Nohfelden, LichtenSTERN.tv, Dr. Ulrike Voltmer, Metzer Strasse 65, 66117 Saarbrücken—hereinafter referred to as “Weltraum-Atelier Nohfelden.”
Weltraum-Atelier Nohfelden is the issuer of the tickets. The purchase of tickets establishes a contractual relationship exclusively between the respective customer and Weltraum-Atelier Nohfelden. Weltraum-Atelier Nohfelden reserves the right to amend these Terms and Conditions at any time; such amendments shall take effect as soon as they are published on this website. Weltraum-Atelier Nohfelden also reserves the right, at its sole discretion and without prior notice, to discontinue or modify the website in whole or in part. By placing an order, the purchaser of tickets (hereinafter referred to as the “Customer”) accepts these Terms and Conditions. Any conflicting terms and conditions of the Customer shall not apply.
Use of the Website:
The customer agrees to use this website solely for the purpose of purchasing tickets. Without express permission, it is prohibited to create deep links to this website—for any purpose whatsoever.
The customer agrees not to use any robot or spider software, nor to attempt in any other way—whether automated or manual—to monitor or copy this website and its content. The user also agrees not to interfere with the proper functioning of this website in any way, particularly by intentionally overloading the system infrastructure of Weltraum-Atelier Nohfelden. Weltraum-Atelier Nohfelden will investigate any illegal and/or unauthorized use of this website—in particular, unauthorized ticket purchases, unauthorized framing or linking to the website, or the unauthorized use of any robots, spiders, or other software—and will take appropriate civil and criminal legal action.
Conclusion of the Contract:
The binding offer to conclude the contract is made by the customer as soon as he completes the ordering process for the selected online tickets. The contract between Weltraum-Atelier Nohfelden and the customer is concluded upon online confirmation.
No warranty is provided regarding the accuracy of the data contained in the online system. Weltraum-Atelier Nohfelden is entitled to cancel an order placed by the customer—for which a transaction number / order number / order number has already been assigned (unilateral right of withdrawal) if the customer violates specific conditions set by the organizer—which were communicated during the advance sale—or attempts to circumvent them (e.g., violation of restrictions on the number of available tickets, in particular prohibitions on resale, etc.). The cancellation or withdrawal may also be implied by crediting the amounts paid.
By submitting their order by clicking the corresponding button, the customer makes a binding offer to enter into a contract. During the ordering process, the customer must first enter, in particular, information regarding the order quantity (number of tickets), their correctly entered email address as the delivery address, and all necessary payment information.
After the order is submitted and received, the customer will receive a confirmation email regarding the purchase. Upon sending this confirmation message (hereinafter referred to as the “Purchase Confirmation”), the purchase agreement for tickets between the customer and Weltraum-Atelier Nohfelden is concluded (hereinafter referred to as the “Agreement”). The Purchase Confirmation also serves as the invoice. Immediately after the purchase is completed, the tickets are made available to the user in PDF format and as a wallet for download in their user account.
The PDF grants access to the event on the respective event days, both when viewed digitally on a mobile device (e.g., smartphone) and in printed form. Customers can save the Wallet ticket on a mobile device and use it as a means of admission.
Limitations of Liability, Exclusion of the Right to Withdraw in the Event of Certain Breaches of Duty
Weltraum-Atelier Nohfelden is liable, in accordance with the provisions of the Product Liability Act, for damages caused intentionally or through gross negligence, in cases of fraudulent concealment of defects, and for damages resulting from injury to life, limb, or health.
In the event of a breach of material contractual obligations (so-called cardinal obligations) resulting solely from ordinary negligence, Weltraum-Atelier Nohfelden’s liability is limited to compensation for foreseeable damages typical for this type of contract.
Except in the cases specified in paragraphs 1 and 2, Weltraum-Atelier Nohfelden shall not be liable for damages caused by simple negligence.
The customer’s right to terminate the contract due to a breach of obligation for which the organizer is not responsible and that does not consist of a defect in the goods is excluded.
A breach of obligation by the customer also includes failing to attend an event or failing to arrive on time. Arriving late or failing to attend does not entitle the customer to a reduction in the purchase price or a refund of the ticket.
To the extent that Weltraum-Atelier Nohfelden’s liability is excluded or limited pursuant to the preceding paragraphs, this also applies to the liability of its agents and vicarious agents.
Copying or Transferring Tickets
In particular, ticket holders are prohibited from:
• selling tickets on auction sites;
• selling tickets for commercial purposes without the express prior written consent of Weltraum-Atelier Nohfelden;
• selling tickets as part of a private transfer at a price higher than that stated on the tickets;
In the event that a ticket is transferred, the customer must provide Weltraum-Atelier Nohfelden, upon request, with the name, address, and date of birth of the new ticket holder. If a ticket is used for the aforementioned unauthorized purposes or if the ticket holder otherwise violates these Terms and Conditions, the ticket will become invalid. In this case, Weltraum-Atelier Nohfelden is entitled to block the ticket—including electronic tickets—and to deny the ticket holder access to the arenas without compensation or to remove the ticket holder from the event venue.
Tickets and registration codes are provided by making them available for download in the customer’s user account. The customer is required to check the tickets for accuracy and completeness immediately upon receipt—specifically, the name of the event, date, time, price, and quantity—and to notify Weltraum-Atelier Nohfelden of any complaints in writing via email to anmeldung@apollo-13.eu within 3 business days. The customer is not authorized to reproduce, duplicate, or alter the ticket. An unauthorized copy or resale of the ticket does not entitle the holder to attend the event. The single-use barcode on the ticket is electronically validated at the event venue using a barcode scanner. It is therefore impossible for additional people to gain access to the event using the same barcode, for example, by duplicating it. In the event that copies of this ticket appear, Weltraum-Atelier Nohfelden reserves the right to deny admission to the event to the owners of the copies or to the owner of the unauthorized copy of the ticket. Furthermore, it reserves the right to demand payment of the total value of the duplicated tickets from the customer whose ticket was unauthorizedly duplicated due to their own fault. Tickets should be kept in a safe place, just like cash or traditional tickets, to prevent misuse. Weltraum-Atelier Nohfelden assumes no responsibility for lost and/or misused tickets.
Personalized Tickets
If ticket personalization is required for the event, tickets must be personalized during the registration process. For bookings made for groups or multiple people, customers must identify themselves as a single group upon entry, and the number of tickets booked must not exceed the number of people in the group. In this case, an additional payment in cash will be due on site. If the customer has purchased tickets for themselves, they will receive personalized tickets in PDF format. The PDF grants access to the exhibition grounds both when displayed digitally on a mobile device (e.g., smartphone) and in printed form. If the customer is provided with a wallet ticket along with the purchase confirmation, they can save it on a mobile device. The wallet ticket can then be used as a means of admission.
Ticket Returns, Right of Withdrawal
Every ticket order becomes binding immediately upon receipt of the confirmation email and obligates the customer to accept and pay for the tickets provided. No refund of the purchase price will be issued for unregistered or unused registration codes. The only exception applies to tickets for (a) canceled or (b) rescheduled events. In these cases, the original customer is entitled to a refund of the ticket price actually paid. Tickets do not need to be returned in such cases; instead, they are automatically invalidated. Furthermore, claims for reimbursement of wasted expenses are excluded. Even though Weltraum-Atelier Nohfelden offers tickets via means of distance communication as defined in Section 312c(2) of the German Civil Code (BGB) and a distance sales contract may therefore exist pursuant to Section 312c(1) BGB, the customer has no right of withdrawal when purchasing a ticket pursuant to Section 312g(2)(9) BGB (exception for the provision of a service on a specific date or during a specific period)!. Tickets lost or destroyed by the customer will not be replaced or refunded. Refunds of the ticket purchase price as a gesture of goodwill are subject to the discretion of Weltraum-Atelier Nohfelden, which will be determined on a case-by-case basis.
